It provides a detailed description of the condition of the dwelling, its fixtures, and its amenities (walls, floors, faucets, appliances, heating, etc.), before a tenant moves in (move-in inventory) and before the tenant moves out (move-out inventory).<\/p>\n<p>It must be conducted in the presence of both parties, that is, with the tenant and the landlord (or their representatives: real estate agency, bailiff, etc.) present.<\/p>\n<p>This document is a reference tool, required by the ALUR Act, that protects both parties in the event of disagreements regarding the condition of the dwelling at the end of the lease:<\/p>\n<ul>\n<li>The tenant must prove that he or she returned the dwelling in the same condition as when he or she moved in, except for normal wear and tear.<\/li>\n<li>The landlord may withhold funds from the security deposit in the event of damage.<\/li>\n<\/ul>\n<h3>What should you check during the move-in inspection?<\/h3>\n<p>The move-in inspection must be precise, thorough, detailed, and conducted with care, and should include supporting photographs to avoid any disputes. Be sure to test the faucets and toilet flush, as well as the outlets and light switches;<\/li>\n<li>The condition of the provided equipment (boiler, electric water heater, fully equipped kitchen, appliances, light fixtures, etc.), along with a detailed inventory in the case of a furnished rental;<\/li>\n<li>Water, gas, and electricity meters, the readings of which must be recorded;<\/li>\n<li>The proper functioning of door keys, mailbox keys, and access badges for the residence;<\/li>\n<li>The overall cleanliness of the residence.<\/li>\n<\/ul>\n<p>To be valid, the move-in inspection report must be signed by both parties: the tenant and the landlord (or by the agency representing the landlord).<\/p>\n<p>The tenant may add comments to the inventory if he or she notices any discrepancies. The tenant has 10 days after receiving the keys to report any errors or omissions (Article 3-2 of the Law of July 6, 1989).<\/p>\n<p>The move-in inspection is conducted when the keys to the residence are handed over to the tenant and will be attached to the lease.<\/p>\n<h3>What should you check during the move-out inspection?<\/h3>\n<p>The move-out inspection takes place at the end of the lease. In the event of a disagreement over the findings or a refusal to sign a move-in or move-out inspection report, there are several options available:<\/p>\n<ol>\n<li>The Departmental Conciliation Commission (CDC), which is free and open to all tenants and landlords.<\/li>\n<li>Seeking the assistance of a judicial officer to resolve the dispute.<\/li>\n<li>As a last resort, after involving a bailiff, the matter must be brought before a court, which is a lengthy process.<\/li>\n<\/ol>\n<p>These steps help prevent prolonged disputes and ensure a faster refund of the security deposit.<\/p>\n<h2>What happens if there is no move-in inspection?<\/h2>\n<p>The absence of a move-in inspection generally works in the tenant's favor.<\/p>\n<p>Under Article 1731 of the Civil Code, the law presumes that the dwelling was handed over in good condition and must be returned in the same condition, unless proven otherwise.<\/p>\n<p>A landlord who rents out their property without a pre-lease inspection may face difficulties in providing evidence in the event of damage to the premises during the lease term or in the event of a dispute when the tenant moves out.<\/p>\n<p>This can complicate any deduction from the security deposit.
