It convenes a meeting of all co-owners at least once a year, whether they are occupants or <a href=\"https:\/\/new-auteuil-immobilier.fr\/en\/landlord\/\">lenders<\/a>. Decisions are made by vote in the form of resolutions: maintenance work, approval of financial statements, election of the property manager, amendments to the condominium bylaws, selection of service providers, etc.<\/p>\n<p>There are two types of general meetings:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The annual general meeting, which must be held once a year;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">An extraordinary general meeting, held when an urgent decision must be made (unforeseen repairs, damage, compliance issues, etc.).<\/li>\n<\/ul>\n<h2>Who organizes and convenes the general meeting of co-owners?<\/h2>\n<p>In principle, the property manager is responsible for convening the general meeting. The property manager must send a notice of the meeting to each co-owner at least 21 days before the meeting, by certified mail, in person, or electronically (if the co-owner agrees).<\/p>\n<p>The homeowners' association board, or a group of co-owners representing at least one-quarter of the votes, may also request that a general meeting be held.<\/p>\n<p>The notice must always specify:<\/p>\n<ul>\n<li>The date and time of the meeting;<\/li>\n<li>The location;<\/li>\n<li>Agenda;<\/li>\n<li>The necessary documents (quotes, financial statements, draft contracts, etc.);<\/li>\n<li>A mail-in ballot.<\/li>\n<\/ul>\n<h2>How is the agenda for the general meeting set?<\/h2>\n<p>The agenda is prepared by the property manager in collaboration with the homeowners\u2019 association board. It lists all the decisions that will be put to a vote: construction projects, budgets, contracts, legal matters, and the election of the property manager.<\/p>\n<p>Any co-owner may request that an item be added to the agenda, provided that the request is made well in advance of the mailing of the notice of meeting.<\/p>\n<p><strong>Good to Know<\/strong> : Only items on the agenda may be put to a vote. Items not on the agenda may be discussed at the end of the meeting, but may not be put to a vote.<\/p>\n<h2>How does a general meeting of co-owners take place?<\/h2>\n<p>The Annual General Meeting may be held:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">In-person;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Via videoconference;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Via conference call;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Through any means of communication approved by a previous general meeting.<\/li>\n<\/ul>\n<p>Upon arrival, each co-owner signs the attendance sheet. This sheet lists the owner\u2019s name, ownership percentage, and method of participation (in person, by proxy, or by absentee ballot). It must be attached to the minutes and approved by the chair of the meeting.<\/p>\n<p>At the beginning of the meeting, the co-owners shall appoint:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">A chairperson (who must be a co-owner);<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">A secretary (usually the property manager);<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Sometimes one or more election officials.<\/li>\n<\/ul>\n<p>The building manager may neither preside over the meeting nor be authorized to represent a co-owner. Next, the resolutions are addressed one by one, in the order specified in the notice of meeting.<\/p>\n<h2>How does voting take place at a general meeting of co-owners?<\/h2>\n<p>Each co-owner has a number of votes proportional to their share, that is, to their proportionate share of the common areas. Voting may take place by a show of hands, in writing, or using the mail-in ballot form. Decisions are then adopted based on different majority thresholds:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Simple majority (Article 24)<\/strong> : used for day-to-day management decisions, such as building maintenance, minor repairs, or insurance matters.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Absolute majority (Article 25)<\/strong> : required for major decisions, including the appointment of the property manager, certain improvement projects, or measures aimed at reducing energy consumption. If this majority is not reached but at least one-third of the votes have been obtained, a second vote may be held by a simple majority.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Double majority (Article 26)<\/strong> : required for major decisions such as the sale or purchase of common areas, or amendments to the condominium bylaws.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Unanimity <\/strong>: required for the most significant changes, such as modifying the <a href=\"https:\/\/new-auteuil-immobilier.fr\/en\/condominium-fees\/\">allocation of expenses<\/a>, the removal of a community facility, or taking out a loan in the name of the homeowners\u2019 association.<\/li>\n<\/ul>\n<p><strong>Good to Know<\/strong> : When a co-owner holds more than half of the votes, the number of votes that co-owner holds is automatically limited to the total number of votes held by all other co-owners combined, in order to prevent excessive dominance during voting.<\/p>\n<h2>What document is provided after the meeting: What is the purpose of the minutes?<\/h2>\n<p>At the end of the general meeting, the property manager drafts the minutes, which are signed by:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The chair of the meeting;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The secretary;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The poll workers.<\/li>\n<\/ul>\n<p>The report must include:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Resolutions adopted;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The exact results (votes in favor, against, and abstentions);<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Opposing or defaulting co-owners;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Any reservations.<\/li>\n<\/ul>\n<p>The property manager must serve the notice of violation within one month:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">By certified mail to opponents and defaulting parties;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">By regular mail or via the extranet for everyone else.<\/li>\n<\/ul>\n<h2>Can a decision made at a general meeting be challenged?<\/h2>\n<p>Yes. Co-owners who oppose the decision or were absent have two months from the date of notification of the minutes to challenge the decision in court. The presence of an attorney is required.<\/p>\n<p>A decision may be overturned if:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The procedure was not followed;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The decision appears to be unjustified or improper;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">An essential document was not provided.<\/li>\n<\/ul>\n<h2>How does an extraordinary general meeting work?<\/h2>\n<p>An Extraordinary General Meeting (EGM) is called when decisions must be made urgently, outside of the annual general meeting: safety work, an emergency, mandatory compliance, etc.<\/p>\n<p>It follows exactly the same rules as an ordinary general meeting (notice, voting, and minutes), but generally has a limited agenda.<\/p>\n<h2>What are the property manager's responsibilities after the general meeting?<\/h2>\n<p>After the meeting, the property manager must:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Notify the minutes;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Initiate the approved procedures (construction projects, contracts, fundraising campaigns, etc.);<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Update the condominium documents;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Keep residents informed of decisions that affect their living environment;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Track the progress of the initiatives until the next general meeting.<\/li>\n<\/ul>\n<h2>What are the best practices for effectively preparing for a general meeting?<\/h2>\n<p>To participate effectively in the general meeting, each co-owner should take the time to read the notice of the meeting and all attached documents, ask the property manager or the homeowners\u2019 association board any questions before the meeting, prepare their positions on the various items on the agenda, and, if unable to attend, submit a proxy or vote by mail.
