If this difference is positive (properties are most often sold for more than they cost), it constitutes income for tax purposes.<\/p>\n<h2>Capital Gains on Real Estate Sales: Scope of Application<\/h2>\n<p>The <b>real estate capital gains<\/b> cover real estate sales transactions, whether they are conducted directly between the buyer and the seller or through a real estate investment partnership.<\/p>\n<p>Here are the various possible scenarios:<\/p>\n<ul>\n<li>Capital gain on the sale of an apartment;<\/li>\n<li>Capital gain on the sale of a house;<\/li>\n<li>Capital gain on the sale of land.<\/li>\n<\/ul>\n<p>Please note that, in the specific cases of inheritance or a gift of real estate, the capital gain corresponds to the <b>declared value<\/b> of the property.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>In France, income generated from capital gains on real estate is taxed in a unique way. In fact, the capital gains tax on real estate is not collected as part of the income tax return. It is <b>calculated and collected upon signing the deed of sale<\/b>. It is the responsibility of the notary handling the case to collect and remit the amount of this tax to the tax authorities once the<a href=\"https:\/\/new-auteuil-immobilier.fr\/en\/final-deed-of-sale\/\">notarized document<\/a>.<\/p>\n<h2>How is capital gain on the sale of real estate calculated?<\/h2>\n<p>In simple terms, it is a <b>the difference between the purchase price and the sale price<\/b> of the property. For example, if you bought a property for \u20ac150,000 and sold it for \u20ac200,000, your capital gain would be \u20ac50,000.<\/p>\n<p>In addition to this, there are a number of <b>patches<\/b> in order to reduce the amount of taxable capital gains. In fact, it is possible to increase the purchase price, particularly by adding purchase expenses and the costs of renovations. Conversely, the sale price can be reduced, for example, by subtracting the real estate agency\u2019s commission, if the seller is responsible for paying it.<\/p>\n<h2>How is capital gain on real estate taxed?<\/h2>\n<p>French tax law provides for two types of taxes:<\/p>\n<ul>\n<li><b>The Tax<\/b> on capital gains from real estate, which amount to 19%;<\/li>\n<li><b>Social Security Contributions (CSG\/CRDS)<\/b> on capital gains from real estate, which amount to 17.2%.<\/li>\n<\/ul>\n<p>So you should expect it to take about <b>36.2% tax<\/b> on capital gains from the sale of real estate.<\/p>\n<p>Please also note that a <b>surcharge<\/b> applies to capital gains exceeding \u20ac50,000. This surcharge can range from 2% to 6% on top of the standard rate, depending on the amount of the capital gain. It applies only to the sale of residential property (i.e., excluding the sale of land).<\/p>\n<h2>How can you qualify for a capital gains tax exemption on the sale of real estate?<\/h2>\n<p>Taxes on real estate sales can be particularly high. Fortunately, in addition to the capital gains calculated on the sale of real estate, there are <b>a number of tax exemptions<\/b>. They were established by the legislature so as not to discourage buying and reselling in the real estate market.<\/p>\n<h2>Capital Gains Tax Exemption on the Sale of a Primary Residence<\/h2>\n<p>The best-known and most significant tax exemption applies to <b>the sale of a primary residence<\/b>, which is currently exempt from capital gains tax. Currently, you are not subject to capital gains tax on the profit realized from the sale of your primary residence (as well as any outbuildings, if sold at the same time), regardless of the amount of the profit or the length of time you owned the property. This exemption therefore applies to the majority of real estate sales.<\/p>\n<p>What about <b>in case of a move<\/b>\u00a0? By definition, if you move out before the deed of sale is executed, the property is no longer your primary residence. You therefore risk losing your right to the tax exemption. Rest assured: the tax authorities allow for a reasonable period of time between the move and the actual sale of the home, provided that the property was your primary residence until it was put up for sale. If the delay exceeds one year, you should be prepared to provide justification, such as lengthy negotiation periods, specific characteristics of the home, or the state of the real estate market.<\/p>\n<h2>Other Cases of Capital Gains Tax Exemptions on Real Estate Sales<\/h2>\n<p>Other scenarios are taken into account for exemption from capital gains tax on real estate. There is an exemption on the <b>first sale of a second home<\/b> (This applies provided that you do not own your primary residence and have not owned one in the past 4 years.
