What are the notary fees for an older property?

Notary fees for an older property generally range from 7 to 8 percent of the property's sale price.

These fees are paid upon signing the deed of sale at the notary, which is responsible for collecting these amounts. Once the fees have been paid, they are then distributed among the various entities involved, primarily the federal government, local governments, and the service providers that participated in the transaction.

What are the notary fees for a new property?

For new real estate properties, notary fees range from 2 to 3 percent of the sale price. This reduced rate is due to lower taxes, particularly registration fees.

Just as with an older property, these fees are paid to the notary when the deed of sale is signed. The notary, acting as an intermediary and “tax collector,” is responsible for forwarding these fees to the appropriate authorities.

Why do notary fees differ between older and new homes?

Notary fees differ significantly between older and new homes due to the taxes that make up these fees. Whether for a new or older property, notary fees include taxes, the notary’s fees, and miscellaneous expenses such as those related to finalizing the sale.

However, the main difference lies in the real estate advertising tax, a component of registration fees. For a new property, this tax is only 0.715% of the property’s pre-tax price, whereas for an existing property, it amounts to 5.80%.

What do notary fees consist of for existing and new properties?

Notary fees consist of several components, whether the property is new or existing:

  • The transfer taxes : These fees, which amount to approximately 5.80% of the sale price for an older property, are intended to finance various tax obligations for the state, the department, and the municipality. For new construction, these fees are much lower, as the land registration tax is reduced;
  • Fees and disbursements: These are the amounts paid by the notary to cover the costs of the various parties involved in finalizing the sale (urban planning fees, mortgage registration fees, extract from the land registry, etc.);
  • Notary fees: These are the notary’s fees, which are generally about 1% of the sale price. These fees are set by a government schedule and therefore do not vary from one notary to another.

How can you reduce notary fees when buying a home?

The options for reducing notary fees are limited, as the majority of these fees consist of mandatory taxes. However, since the Macron Law of 2016, notaries may grant a discount on their fees for transactions exceeding several million euros, for amounts above €150,000, up to a maximum discount of 10%.

How are notary fees calculated for existing and new properties?

To calculate the amount of notary fees, let’s take the example of two properties valued at €400,000 each—one new and the other older. 

For a new home:

  • Notary fees, including tax: €4,311;
  • Duties and taxes: €2,859;
  • Fees for administrative procedures and out-of-pocket expenses: €1,360;
  • Property Security Fee: €400;
  • Total: 8,931 €.

For an older property:

  • Notary fees, including tax: €4,311;
  • Duties and taxes: €23,226;
  • Fees for administrative procedures and out-of-pocket expenses: €1,360;
  • Property Security Fee: €400;
  • Total: 29,298 €.
