Contrary to popular belief, the payment of a deposit is not not legally required when purchasing real estate. However, it is a common practice and highly recommended. The down payment serves as warranty for the seller and demonstrates the buyer's seriousness about the purchase. It is generally requested at the time of signing the sales agreement or the offer to purchase.
What is the typical amount of a down payment when buying a home?
The amount of the down payment is not set by law, but it is generally between 5% and 10% of the price of sale of the property. For example, for a property valued at €300,000, the down payment could range from €15,000 to €30,000. This amount may vary depending on several factors, such as the property’s value, market conditions, or agreements between the parties.
What is the difference between a down payment and a security deposit?
Although they are often confused, the down payment and the reservation fee—often called a security deposit—are two distinct concepts. The down payment is an initial payment that is an integral part of the sale price. It is deducted from the total amount upon signing thenotarized document.
On the other hand, the security deposit is a sum paid as a guarantee of the buyer’s commitment. If the sale goes through, it is deducted from the price; otherwise, it may be retained by the seller if the buyer withdraws from the transaction; it is, in effect, a deposit to secure the property.
