What does an asbestos assessment involve?

The asbestos assessment involves detecting the presence of materials containing asbestos in a building. Asbestos, which was once commonly used in construction because of its insulating properties and fire-resistant, is now recognized as a health hazard. Inhaling asbestos fibers can cause serious diseases, such as asbestosis, lung cancer, and mesothelioma.

An asbestos assessment, conducted by a certified professional, involves a visual inspection of materials that may contain asbestos, followed, if necessary, by sampling and laboratory analysis. The results are documented in a detailed report, the Asbestos Technical File (DTA), which provides information on the presence, condition, and any recommended actions regarding asbestos-containing materials.

Which properties are subject to an asbestos inspection?

An asbestos inspection is required for all buildings for which a building permit has been issued before July 1, 1997. This date marks the ban on the use of asbestos in new construction in France. The properties affected include single-family homes, condominium units, as well as commercial and industrial facilities.

In the event of a sale, the inspection report must be included in the Technical Diagnostic Report (DDT) provided to the buyer. For rentals, although an asbestos inspection is not required, it is strongly recommended to inform the tenant of the condition of the property.

Who is required to conduct the asbestos survey?

The property owner is responsible for conducting the asbestos inspection. He must hire a certified real estate inspector to perform this assessment.

How long is an asbestos assessment valid?

The validity period of an asbestos assessment depends on the date it was conducted:

  • For asbestos inspections conducted effective April 1, 2013, the report is valid indefinitely. However, it is recommended that you have the inspection redone at the time of the next sale or if major renovations have been carried out in the home. Such renovations may indeed reveal materials or products containing asbestos that were not visible when the previous inspection was conducted.
  • For the diagnoses made before April 1, 2013, they must be renewed before the home is sold.

What should you do if asbestos is present?

If asbestos is present, several steps can be taken:

  • Regular monitoring : If asbestos-containing materials are in good condition, periodic monitoring may be sufficient to ensure that they do not deteriorate.
  • Lockdown : This method involves covering asbestos-containing materials to prevent the release of asbestos fibers.
  • Withdrawal : In cases where asbestos poses a significant health risk, it is recommended to hire a company that specializes in asbestos removal to remove the contaminated materials.

What are the penalties for noncompliance?
